TERMS OF SERVICE

Onekiguwolf Commissions: How should we do this?

Heya, and thank you (The Client) for getting a commission from Onekiguwolf (The Artist).

These Guidelines ("The Terms" or "Terms of Service") are my basis for creating a commission, starting from when you made your first inquiry, to what happens after the commission has been made. I want to make sure that as I am quite new to this, that your rights as a consumer are respected, and that I won't get overwhelmed with problems that will hamper this service. I hope that you, the commissioner, would help this wolf understand you better so we don't get into conflicts whatsoever!

1.) Inquiries and before the commission

Note 01: As I am not accepting IRL currency at this time, these are based on my discord.

1.1) Please be Civil at all times.

I want to make sure that as much as possible, it will be hard for me to understand you if you are inappropriately speaking to me. If possible, try to be concise and straight to the point. Please know that I also have a right to refuse your commission for undesirable behavior.

1.2) Always provide a ref.

References are a need for me so I can understand the character I am going to draw. If it's my first time drawing a certain species, do expect me to come by and have a chat with you any time about the artwork so I can correct some things as quickly as I can. If it's your first time getting a reference sheet of your OC, please don't hesitate to let me know so we can have a chat on what your OC looks like. Don't be scared of me, I won't bite!

Please make sure as much as possible to provide a reference sheet of at least a good or high quality.

1.3) Let me know if it's for business use.

Sometimes I am unaware that this commission is for your business (like a fanart of your discord server mascot, etc..). Whether it is for your Discord Server or just a personal business, please make sure to inform me prior to the start of work.

2.) During the Commission

2.1) Confirm first!

I want to make sure that the client has confirmed their slot. In this case, it is advisable that you should let me know if your decision is final to commission from me. This is so that you can have some time to think things through when you are ready. No pressure! Think about what's best for you.

2.2) Art First, Payment After.

It's a policy for myself: I won't accept payment until I have finished the commission to ensure the quality of the artwork. If you need to pull out mid-way, please inform me as soon as possible. I want to make sure that you get the artwork that you always wanted in better quality, hence this policy.

2.2.1) As I am not taking IRL Currency as payment yet, please refer to the discord server you came from for the ToS. (Cyanide Heights, or other Discord Server). An example is on Cyanide Heights, where you must purchase a certain item through Tatsu to get a commission.

2.3) Patience is a virtue.

This is one important thing that most people often overlook in commissioning a furry artist: Time. As a person myself, even I have a life behind the screen (whether it is school, family, etc.). Usually, I would take in around 3 or more weeks, depending on how big is this artwork. If possible, please do be patient with me during the commission. You can ask how's the artwork, but please don't do it repetitively when I haven't started yet. Don't be anxious! I will always be with you at every step of the commission to let you check If I made some mistakes on certain design patterns, etc.

2.4) Communication with me is Key to great art!

Not exactly what it says means on all artists, but for me, I want to make sure that you get to see the progress of the art every single step of the way. Please expect me to go in from time to time to show my progress and allow you, the commissioner, to tell me if there is anything I need to do before completing the next step.

3.) After the commission and Copyright/Legal policies

3.1) Rights of the Artist

Since I did drew the art myself, I have the right to reproduce, share, and post the output of your commission. This is so that it can help me reach greater audiences who may take an interest in what I do!

3.2) Changes after the commission

Forgot to change some slight details on the art? Let me help you with that. As the customer, you have the right to let me know about fixing some errors on your commission. I can only take some slight edits, but major edits may incur additional charges.

3.3) Artwork Copyright - As a client

As you have commissioned from me, you have all the rights to share the artwork or use it for personal reasons only! Section 1.3 overrides this if it is for a business purpose. If you wish to reproduce it physically or giving the artwork and its rights to someone else (an example would be giving your OC as adoption to someone else), please inform me to whom you gave it and at least a possible way to contact them. This is so that even if you are no longer the owner of the artwork, the copyright is still preserved. For reproduction (like selling it as a print on your shirt), let me know as well so we can work out how it would benefit both of us while preserving the rights of you, the client, and me, the artist.

3.4) Artwork Copyright - For non-clients

Thanks for your interest in viewing all of my art! I reserve all the rights of my art to reach a wider audience, and I do not want to get into legal trouble on Copyright. as such, please do not reproduce or edit the artwork. If you wish to share the artwork, please credit me at all times! It helps me to find more people who take an interest in my art. Some examples of violating this are, but are not limited to:

3.4.1 - Using my art for Profile pictures, cover art, or anything synonymous.

3.4.2 - Using my art for stickers, emojis, and the like.

3.4.3 - Editing my artwork by removing the watermark and my copyright signature for reproduction (aka Plagiarism).

3.4.4 - Using my artwork for Non-fungible tokens (NFTs) and cryptocurrencies. I strongly prohibit the usage of NFTs on ANY of my artwork.

As an artist, I will not hesitate to take legal actions (if applicable) if any of these prohibited actions (or any synonymous actions) are made without my consent, and may lead to alerting the local authorities. I hope you respect my rights as an artist!

3.5) Other concerns

Such other concerns may be the commissioner being blocked from getting a commission from me, or anyone who violates the terms of service. I would allow appeals by contacting me so we can talk about what happened and what we can do to alleviate this problem, as well as other questions that you may have that are not in these terms (I am open to learning more to improve my terms to serve you better!). IF YOU HAVE MADE A GRAVE VIOLATION TO ANY OF THESE, YOU HAVE NO RIGHT IN ANY FORM TO COMMISSION FROM ME, THE ARTIST, AND ALL OF YOUR RIGHTS TO ANY ARTWORK THAT WERE MADE BY ME BEFOREHAND WILL BE NULLED, VOIDED, AND REVOKED.

4.) The right to update these terms

I, the artist, have the sovereign right to edit or manipulate parts of the Terms of Service to be more understandable whether you are a client or not, so please review this frequently. If I did somehow made changes to these, you have the right to ask me more about the changes, and to be informed through the blogposts I made within this website. so you will be aware of how I will now handle commissions starting from your inquiry, up to the events beyond our contact.
